Summary: Submitted by Senator WESTLUND -- Relating to denial of unemployment benefits for failing preemployment drug or alcohol test.

Details: SB 397 seems to change some wording of ORS 657.176... that would affect the following scenario ... at one point there was a case involving an employer that allowed the claimant to begin working prior to receiving UA results, which he/she ultimately failed and under the UI laws, rules and policy, this claimant was allowed benefits, even tho it was for illegal drug use.

It seems they will now allow the person to start work and allow for 14 days for the UA results.  From an unemployed workers perspective they will now not have to wait to start employment.  As of mid 2002, any issues relating to discharges due to the use of medical cannabis, were written as clearing w/regards to UI.

The claimant and doctor both have more credibility than workplace drug abuse policy, as far as the chosen methods of treatment.   As long as the claimant was not discharged due to illegal drug use there was no issue re: UI benefits.

ANALYSIS

As we do stuff we should look at this bill and respond concerning ideas of the propriety of denying benefits.  Write all members please and explain the problem with this bill.  Be sure to lets us know your points and their responses!
