Nevada   Information pages Assembly Committee Considering Bill to Legalize and Regulate Marijuana | Assemblyman Joe Hogan (D-District 10) and co-sponsors have introduced legislation to legalize and regulate the adult use of marijuana. Assembly Bill 402 provides for a legislative framework for the retail production and sale of cannabis to adults. The Nevada Assembly Judiciary Commitee heard testimony on AB 402 on Friday, April 5th, but have yet to vote on the measure. Speaking in favor of the bill, primary sponsor Assembley Joe Hogan stated this legislation was "about coming to terms with reality and showing some courage. The prohibition against marijuana has essentially failed," Hogan told committee members. "It has created a black market that hangs like a cancer alongside our unfunded education system."   >> here << Senate Committee Approves Bill to Allow for Medical Marijuana Dispensaries | The Senate Judiciary Committee approved Senate Bill 374, which would allow for the establishment of facilities to dispense medical marijuana to authorized patients, on Thursday, April 11. The measure now awaits action from the full Senate. Sixty-five percent of state voters approved legislation in 2000 to allow for physician authorized patients to consume and grow cannabis. However, the law does not explicitly provide for facilities where authorized patients may obtain medicinal cannabis. One of those positive bills was Asm. Paul Aizley’s A.B. 235, which would have amended Nevada’s medical marijuana law to make the registry identification card optional and allow for collective cultivation and possession between patients and caregivers. A.B. 438, which would have created a regulated dispensary system in Nevada, and S.B. 336, which would have created a pilot program for regulated medical marijuana distribution using compound pharmacies, cultivation sites, and safety compliance testing laboratories, both died in committee. Local organizer Dave Schwartz worked with MPP to help kill S.B. 256 in the Assembly after it passed the Senate. It would have increased cultivation penalties, made it more difficult to become a caregiver and easier to get one’s medical marijuana ID card revoked. One objectionable bill that did pass this year and became law is A.B. 528, which will authorize the Department of Health and Human Services to transfer funds from the medical marijuana program to the Department of Mental Health Services to provide alcohol and drug abuse programs to child welfare services referrals. This is problematic, as patients already pay up to $242 to get an ID card, and the price should be lowered, especially for low-income patients, instead of raiding the ID card funding mechanism for outside programs. Nevada voters passed the state’s medical marijuana law, Ballot Question 9, into law on Nov. 7, 2000, with an impressive 65% of the vote. The legislature implemented the initiative, passing A.B. 453 on June 14, 2001 and A.B. 519, on July 1, 2005. Nevada's current medical marijuana law can be found in Nevada Revised Statutes 453A.
