The federal scheduling of Cannabis was disputed in 1988 by Judge Francis Young, an administrative law judge for the DEA, who recommended that marijuana be reclassified as schedule II on the grounds that if a respectable minority of doctors endorse it, then it has a "currently accepted medical use".

Legal and medical status of cannabis - Wikipedia, the free encyclopedia | Cannabis is in Schedule IV of the Single Convention on Narcotic Drugs, making it subject to special restrictions. Article 2 provides for the following, in reference to Schedule IV drugs:
A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.
This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. The official Commentary on the Single Convention indicates that Parties are expected to make that judgment in good faith.

The Rhode Island General Assembly directed the Department of Health to create a medical marijuana program (MMP). The "Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act" was enacted on January 3, 2006 (Public Laws 05-442 and 05-443.
The MMP will permit persons with debilitating medical condition(s) to use marijuana if a physician certifies in writing that the marijuana may mitigate the symptoms of the condition(s) and that the potential benefits of using medical marijuana would likely outweigh the health risks to the patients.

Advocates hopeful the legislature will allow compassion centers in 2009. Legislation to allow up to three compassion centers to dispense medical marijuana to patients made terrific progress this year, which was the first year the proposal was introduced. But sadly, the proposal has not yet become law. The Senate approved the bill in a 29-5 vote in May. But rather than voting on allowing compassion centers, the House voted overwhelmingly in June to establish a study commission on the issue. PROVIDENCE, R.I. (AP) - Nonprofit businesses would be allowed to sell marijuana to chronically ill patients under proposals Rhode Island lawmakers are expected to consider this week.
The bills would allow so-called “compassion centers” to sell up to 2.5 ounces of the drug every 15 days to a patient or his caregiver if they are enrolled in an existing medical marijuana program overseen by the state Health Department. Rhode Island became the eleventh state in the country in 2006 to legalize marijuana for medical purposes, although the drug remains illegal under federal law.

Rhode Island Senate Committee Unanimously Approves Medical Cannabis Measure
- April 10, 2008 | Providence, RI, USA: The Rhode Island Senate Committee on Health and Human Services unanimously approved Senate Bill 2693 Wednesday. S 2693, along with its companion bill, House Bill 7888, would regulate the distribution of medical marijuana by allowing a non-profit state-licensed facility to provide medical marijuana to Rhode Island's licensed patients. Earlier in the week, the committee heard testimony in favor of the bill from state-licensed patient Buddy Coolen of Warwick, who was recently robbed at gunpoint while attempting to obtain the cannabis he is permitted under state law.

Rhode Island: Legislature Makes One-Year-Old Medical Cannabis Law Permanent
- June 28, 2007 | Providence, RI, USA: More than 80 percent of House and Senate lawmakers voted last week to make the state’s one-year-old medical cannabis law permanent. The votes override an earlier veto from the state’s Republican governor, who sought to close the statewide program.
Under the state’s law, known as the Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act, an estimated 300 state-authorized patients and their caregivers are provided state legal protections to possess medical cannabis.
The law was set to expire at the end of June unless it was reauthorized by the legislature.

On 3 January Rhode Island became the 11th state to legalize medical cannabis. The state House of Representatives voted 59-13, with one abstention, to override a veto by Governor Don Carcieri, allowing people with illnesses such as cancer and AIDS to grow up to 12 cannabis plants or buy 2.5 ounces (about 70 grams) of marijuana to relieve their symptoms. The law requires them to register with the state and get a photo identification card.

| This week, Rhode Island became the latest state to legalize medical marijuana -- and the first since the U.S. Supreme Court ruled in June that patients who use the drug can still be prosecuted under federal law.
At that time, the White House drug policy office declared "the end of medical marijuana as a political issue." But with Rhode Island becoming the 11th state to legalize it, pro-medical marijuana groups say the issue is still alive and well.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.

Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
