Availability in Spain.
In Spain, since the late 1990s and early 2000s, medical cannabis underwent a process of progressive decriminalization and legalization. The parliament of the region of Catalonia is the first in Spain have voted unanimously in 2001 legalizing medical marijuana, it is quickly followed by parliaments of Aragon and the Balearic Islands. The Spanish Penal Code prohibits the sale of cannabis but it does not prohibit consumption. Until early 2000, the Penal Code did not distinguish between therapeutic use of cannabis and recreational use, however, several court decisions show that this distinction is increasingly taken into account by the judges. From 2006, the sale of seed is legalized, possession or consumption is still forbidden in public places but permitted in private premises. Moreover, the cultivation of cannabis plants is now authorized in a private place.
Several studies have been conducted to study the effects of cannabis on patients suffering from diseases like cancer, AIDS, multiple sclerosis, seizures or asthma. This research was conducted by various Spanish agencies at the Universidad Complutense de Madrid headed by Dr. Manuel Guzman, the hospital of La Laguna in Tenerife led neurosurgeon Luis González Feria or the University of Barcelona.
After legislation, several cannabis clubs have been established including the Basque Country and Catalonia. These clubs, the first of its kind in Europe, are non-profit associations who grow cannabis and sell it at cost to its members. In 2006, members of these clubs were acquitted in trial for possession and sale of cannabis.

The parliament of Spain's Baleares region voted in April by a large majority to allow doctors on Mallorca to prescribe cannabis for therapeutic purposes. The decision comes after responsibility for the health system was passed on to the regional government by the central government.
The vote means that 60 pharmacies and four hospitals in Catalonia will start prescribing cannabis to patients for whom other treatments have failed. Doctors in Catalonia will be able to prescribe cannabis in capsules or as an infusion for four specific groups of patients: those suffering from AIDS, cancer, chronic pain, or multiple sclerosis. The new policy affects roughly 150,000 patients.
Spain's Health Minister, who must approve such decisions, said she accepted that cannabis "has some therapeutic value" and approves of "the controlled use of tablets in specific cases and under medical supervision."
The pilot project, which will operate for a year, was proposed by Barcelona's College of Pharmacists, following a similar program in the Netherlands with 8,000 patients.

Medical Marijuana.
Marijuana has many possible medical uses. Positive effects are claimed for ailments such as cancer, AIDS, and glaucoma. AIDS can cause a loss of appetite known as "wasting syndrome", which can lead to drastic weight loss and weakness. Chemotherapy used in the treatment of cancer causes nausea resulting in an inability to keep down food.
Marijuana's healing nature for these two illnesses is a result of its ability to increase a person's appetite as well as relieving nausea, allowing a patient to regain weight. Marijuana reportedly helps glaucoma patients by reducing intraocular pressure that can cause damage to the eye.

Cannabis was a part of the American pharmacopoeia until 1942 and is currently available by prescription in the Netherlands, Canada, Spain, and Italy in its whole plant form.
In 1937, the U.S. passed the first federal law against cannabis, despite the objections of the American Medical Association (AMA). Dr. William C. Woodward, testifying on behalf of the AMA, told Congress that, "The American Medical Association knows of no evidence that marijuana is a dangerous drug" and warned that a prohibition "loses sight of the fact that future investigation may show that there are substantial medical uses for Cannabis."
Ironically, the U.S. federal government currently grows and provides cannabis for a small number of patients. In 1976 the federal government created the Investigational New Drug (IND) compassionate access research program to allow patients to receive up to nine pounds of cannabis from the government each year. Today, five surviving patients still receive medical cannabis from the federal government, paid for by federal tax dollars.

Between 1840 and 1900 over 1000 major medical articles recommending cannabis as a therapeutic agent were published.
It is still puzzling that no serious modern survey of the therapeutic value in cannabis has been conducted. This is because it is illegal, and may well be due to pressures from the pharmaceutical and drug companies who fear loss of profits if cannabis is accepted medicinally.
Just imagine all those people growing their own remedy!

i think its legal to have one plant per person in the house..so if its you n 3 room mates, you can have 4 plants in the house n the cops can't do shit if theyre in your house and you can smoke it in your house legally as well..its illegal to sell it and it is illegal to smoke outside, you can get fined like 300 euros..but most cops where i'm from turn the other way if youre in a spot where theres not a lot of people like a park bench at night time or the beach..they just don't care ... i've even smoked a few joints on the way to work walkin on the sidewalk n no one says anything..one time they just told us to go somewhere else cuz we were smoking at a park bench

i am over in Spain, they say it is legal to posses the blessed plant, but in Barcelona i see nothing but control freaks., but then again, grow shops, medical research is openly promoted and controlled., in many ways, way better then the US, even Canada.

N.J. Senate approves medical marijuana bill -

TRENTON BUREAU:
A Senate committee today cleared a measure that would allow medical use of marijuana in New Jersey.
The Senate Health, Human Services and Senior Citizens Committee voted to approve the long-stalled bill by a 6 to 1 margin; two senators abstained.
The bill calls for creating “alternative treatment centers” where people with chronic and terminal diseases would be allowed access to marijuana. Supporters say marijuana is a viable treatment option to alleviate pain in many cases.
“It is the definition of basic human decency that we do whatever we can to ease the pain and suffering of people living with severe chronic and terminal diseases,” said bill sponsor Sen. Nicholas Scutari, D-Union.
“When all other avenues of currently-approved pain relief have been exhausted, we need to give doctors the freedom to prescribe medical marijuana to give their patients a measure of comfort and dignity in the face of their debilitating diseases. This bill is about the most humane, compassionate option for those state residents who have nowhere else to turn in managing their illnesses.”
If ultimately approved by the full Legislature and signed by Governor Corzine, New Jersey would be the 14th state to allow medical use of marijuana.

A new study entitled Marijuana Effectiveness as an HIV Self-Care Strategy, which was released this past weekend in Clinical Nursing Research, indicates that persons living with HIV/AIDS rate cannabis as more effective in treating the symptoms of anxiety, depression, fatigue, diarrhea, and neuropathy than other prescription and over the counter medications.
The study, which was conducted over a two year period and included 775 patients from the USA, Africa, and Puerto Rico, assessed the use of cannabis as a symptom management approach for anxiety, depression, fatigue, diarrhea, nausea, and peripheral neuropathy. 27% of survey participants reported using cannabis for medicinal purposes.
Researchers wrote that cannabis use “was rated slightly more effective than antidepressants for anxiety and depression, Imodium for diarrhea, [over the counter] (OTC) medications for fatigue, and anti-epileptics and OTC medications for neuropathy” while cannabis was rated “slightly less effective for nausea than either prescribed or OTC medications.” Authors concluded that cannabis “is perceived by users as at least as effective as prescribed medications in symptom management.”

The Spanish Health Ministry is expected to give its blessing to a Catalonian plan to allow doctors to prescribe marijuana to patients in need. The London Independent on Sunday reported on Feb. 6, 2005 ( "Spain's Health Ministry To Allow Doctors To Prescribe Cannabis") that "In a bold venture that puts Spain at the forefront of the medical use of cannabis in Europe, 60 pharmacies and four hospitals in Catalonia are to prescribe marijuana for therapeutic use where other treatments have failed. The pioneering scheme surpasses measures taken by the Dutch, leaders in the field, and puts British efforts in the shade. A British drug company has been denied permission to produce medicinal cannabis for trials - because of lack of political will, critics say.
Doctors in Catalonia will be able to prescribe cannabis in capsules or as an infusion to help four specific conditions: anorexia among Aids patients; nausea caused by chemotherapy in cancer patients; constant pain - including migraine - that has been unresponsive to other treatments; and muscular problems among those with multiple sclerosis. About 150,000 patients are expected to benefit. Spain's Health Minister, Elena Salgado, said she accepted that cannabis 'has some therapeutic value'. She approved 'the controlled use of tablets in specific cases and under medical supervision', but insisted on the need to fight drug addiction. Spanish health policy is devolved to the regions, but must receive Madrid's blessing."

A Spanish medical marijuana activist group, the Amigos de María, has announced the creation of the first publicly known medical marijuana dispensary in the country. Operating through the Internet, the "Cannabis Pharmacy" will provide information about medical marijuana, encourage patients to grow their own, and put patients in contact with listed growers who are prepared to donate part of their crops for patients.
While the Cannabis Pharmacy is the first public dispensary, it is not the first Spanish dispensary. As the group noted, "We are aware that other groups have been doing this for several years in a more or less clandestine form.
The only new thing is that we have gone public in the hope that our politicians take note of the matter and normalize, once and for all, the use of cannabis, and until that time arrives, we can reduce the risks of the therapeutic use of cannabis."
Spain is moving jerkily toward acceptance of medical marijuana, with Catalan authorities having authorized a pilot program for marijuana in pharmacies last year. Earlier this year, authorities in Barcelona announced plans for a trial of the marijuana-based sublingual spray Sativex that will involve up to 600 patients and 60 participating pharmacies.

Barcelona, Spain: Spanish health officials have approved the importation and use of Sativex, an oral spray consisting of natural cannabis extracts, for select patients suffering from Multiple Sclerosis (MS), neuropathic pain, and other conditions.
Produced by the British biotechnology firm GW Pharmaceuticals and marketed by Bayer, Sativex is a whole plant medicinal cannabis extract containing precise doses of the cannabinoids THC and cannabidiol (CBD), as well as naturally existing terpenoids (oils) and flavonoids (antioxidants).
In clinical trials, Sativex has been demonstrated to alleviate numerous MS-associated symptoms compared to placebo, including pain, muscle spasms, and bladder incontinence. The drug is available by prescription in Canada and is pending regulatory approval in the United Kingdom.
Six hundred patients, including those suffering from MS, chronic pain, cancer, and the AIDS wasting syndrome, will be provided Sativex under the Spanish Ministry of Health's compassionate access program. The government's limited approval of the drug marks the first time Europeans will have legal access to Sativex outside of a clinical trial.

The plan was agreed by Catalonia's left-wing regional government, a coalition of socialists, Greens and independent republicans. The initiative, due to be approved by the Spanish Health Ministry after more than a year of strenuous lobbying, is expected to prompt Spain's other autonomous regions to adopt similar measures."

US Government Says It Will Stop Interfering with Medical Marijuana |
According to this article, US Attorney General Eric Holder has said that states will be allowed to make their own rules about medical marijuana, and that the US federal government will stop raiding medical marijuana dispensaries in California. (See article “Can Marijuana Help Rescue California’s Economy?”at this link)
In the 1990s, several US states passed referendums which allowed marijuana to be used legally for medical purposes. In a referendum, the registered voters vote directly on the proposed law, as opposed to the law being passed by the state legislature. Thus, when these states passed these referendums, it meant that the citizens of these states really wanted medical marijuana to be made legal.
However, in a blatant disregard for democracy and the people’s will, under the Bush administration, the national government refused to accept this law, and carried out raids of the medical marijuana dispensaries.

Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. Regulada según lo dispuesto en la Ley Orgánica 1/2002 de 22 de Marzo, reguladora del derecho de asociación y careciendo de ánimo de lucro.
Durante estos diez años Alacannabis ha organizado Jornadas Cannábicas en la Universidad de Alicante con ponentes como: Antonio Escotado (escritor), Ignasi Peña (psicólogo), Mario Bellandi (genetista de Delicatessen Seeds Bank) Carlos Bauso (psicólogo y psicoterapeuta), Fernanda de la Figuera y Martín Barriuso (presidentes de la FAC), Héctor Brotons (abogado).
Alacannabis ha organizado también durante estos últimos 10 años la Marcha Mundial de la Marihuana en ALicante, el dia de San Canuto y 8 ediciones de la copa cannábica Alacannabis Cup. Emitimos por internet "Hablemos de Cánnabis" todos los martes desde las 21h00 a las 23h00.

La Asociación Madrileña de Estudios sobre el Cannabis A.M.E.C. es una asociación de consumidores y estudiosos de todo lo relacionado con el cannabis y sus derivados. Fue fundada y dada de alta en el registro de asociaciones en 1995. Desde entonces sus esfuerzos se han encaminado a denunciar los abusos y atropellos que la actual legislación provoca en los consumidores de cannabis y a reclamar, a los poderes públicos, una política de drogas más justa y eficaz.
Para ello, a lo largo de su historia, la AMEC ha organizado copas de la marihuana, concentraciones, manifestaciones, pasacalles cannábicos e incluso jornadas sobre nuestra planta amiga en la Universidad Complutense de Madrid.
Todo ello obedeciendo a nuestro compromiso con la defensa al derecho a que cada persona consuma las sustancias que desee, y la defensa al derecho a tener una verdadera educación sobre drogas, algo opuesto a la propaganda y desinformación que utilizan los gendarmes antidroga.
En la actualidad, la AMEC cuenta con unos 300 soci@s y dispone de un local donde se reúnen los voluntarios que forman los grupos de trabajo, que son los que se encargan de llevar a cabo las actividades e iniciativas. Son grupos abiertos y todos los socios están invitados a participar y a colaborar, ya que son fundamentales para el funcionamiento de la asociación. Si quieres aportar ideas sobre acciones directas o actividades internas o lo que se te ocurra, en la AMEC siempre estamos abiertos a escucharlas y a evaluar su viabilidad y puesta en marcha.
