    Vermont Completely Nullifies Federal Hemp Ban

    Vermont -  Vermont Completely Nullifies Federal Hemp Ban Vermont has become the most recent state to take a stand against the federal government and nullify the federal ban on hemp cultivation. Governor Shumlin signed the new bill into law in June. Hemp is an agricultural product which may be grown as a crop, produced, possessed, and commercially traded in Vermont pursuant to the provisions of this chapter. The cultivation of hemp shall be subject to and comply with the requirements of the accepted agricultural practices adopted under section 4810 of this title. -Senate Bill 157 According to VoteHemp, a hemp advocate website, Vermont is actually the 9th state to lift the ban on hemp, and 20 states have introduced industrial hemp legislation for the 2013 legislative season. However, what makes Vermont unique is that the new law does not hold a stipulation or amendment requiring the federal government to first lift the ban on hemp cultivation.     Vermont -  Marijuana Legalization Legislation Introduced State Legislative and Statewide > Vermont - Marijuana Legalization Legislation Introduced | Legislation has been introduced that seeks to make Vermont the third state to legalize and regulate the adult use of marijuana. Five Vermont lawmakers have introduced House Bill 499, which seeks to tax and regulate the retail distribution of cannabis. You can read the full text of the measure   >> here << Sponsor Rep. Zuckerman stated: "I do think this is a policy whose day will come. Whether it's one year from now or four years from now, I don't know. But I don't think it's something that's 10 years out. I think the tide is shifting."


    Vermont -  Senate Committee Approves Marijuana Decriminalization Legislation State Legislative and Statewide > Vermont - Senate Committee Approves Marijuana Decriminalization Legislation | Legislation that seeks to significantly reduce marijuana possession penalties, Senate Bill 48, was approved in a 4-1 vote by the Senate Judiciary Committee on Wednesday, May 1. The measure now awaits action by the full Senate. Similar legislation, House Bill 200, was approved by House lawmakers in a 98-44 vote. These measures amend the penalty for the possession of an ounce or less of marijuana by a person 21 years of age or older from a criminal misdemeanor to a civil fine. House Bill 200, with nearly 40 co-sponsors, imposes fine-only penalties for the possession of up to two ounces of cannabis, as well as for instances involving the cultivation of marijuana for personal use.   >> Learn more >> << Click > here < for more News.

    Status of Medical Marijuana (Cannabis) in Vermont.

    Vermont has a MEDICAL MARIJUANA (cannabis) LAW

    SUMMARY: Senate Bill 76 became law without Gov. James Douglas' signature on May 26, 2004. The law takes effect on July 1, 2004. The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients diagnosed with a "debilitating medical condition." Patients diagnosed with the following illnesses are afforded legal protection under this act: HIV or AIDS, cancer, and Multiple Sclerosis. Patients (or their primary caregiver) may legally possess no more than two ounces of usable marijuana, and may cultivate no more than three marijuana plants, of which no more than one may be mature. The law establishes a mandatory, confidential state-run registry that issues identification cards to qualifying patients.  

    Approved Conditions:   Cancer, AIDS, positive status for HIV, multiple sclerosis, or the treatment of these conditions if the disease or the treatment results in severe, persistent, and intractable symptoms; or a disease, medical condition, or its treatment that is chronic, debilitating and produces severe, persistent, and one or more of the following intractable symptoms: cachexia or wasting syndrome, severe pain or nausea or seizures.

    Possession/Cultivation: No more than two mature marijuana plants, seven immature plants, and two ounces of usable marijuana may be collectively possessed between the registered patient and the patient’s registered caregiver. A marijuana plant shall be considered mature when male or female flower buds are readily observed on the plant by unaided visual examination. Until this sexual differentiation has taken place, a marijuana plant will be considered immature.

    PATIENT POSSESSION LIMITS: Two ounces of usable marijuana

    HOME CULTIVATION: Yes, no more than nine marijuana plants, of which no more than two may be mature.

    AMENDMENT(s):   Yes

      Amended: Senate Bill 7, which took effect on JULY 1, 2007, expands the definition of "debilitating medical condition" to include: "(A) cancer, multiple sclerosis, positive status for human immunodeficiency virus, acquired immune deficiency syndrome, or the treatment of these conditions, if the disease or the treatment results in severe, persistent, and intractable symptoms; or (B) a disease, medical condition, or its treatment that is chronic, debilitating, and produces severe, persistent, and one or more of the following intractable symptoms: cachexia or wasting syndrome; severe pain; severe nausea; or seizures." The measure also raises the quantity of medical cannabis patients may legally possess under state law from one mature and/or two immature plants to two mature and/or seven immature plants. Senate Bill 7 also amends state law so that licensed physicians in neighboring states can legally recommend cannabis to Vermont patients.

      Amended: Senate Bill 17, (100 KB) "An Act Relating To Registering Four Nonprofit Organizations To Dispense Marijuana For Symptom Relief" Signed by Gov. Peter Shumlin into law on June 2, 2011, allows up to four state-licensed facilities to dispense marijuana to medically authorized patients. Each dispensary will be licensed by the state Department of Public Safety and will be permitted to serve up to 1,000 registered patients. The bill "establishes a framework for registering up to four nonprofit marijuana dispensaries in the state... A dispensary will be permitted to cultivate and possess at any one time up to 28 mature marijuana plants, 98 immature marijuana plants, and 28 ounces of usable marijuana." On Sep. 12, 2012, the State of Vermont Department of Public Safety announced conditional approval (65 KB) of two medical marijuana dispensaries. In June 2013, two dispensaries opened in Vermont.

    CAREGIVERS: Yes. Registered caregiver is a person who has agreed to undertake responsibility for managing the well-being of a registered patient with respect to the use of marijuana for symptom relief. The registered caregiver can never have been convicted of a drug-related crime. The caregiver must be 21 years of age or older. Patients may only have one registered caregiver at a time. Registered caregiver may serve only one registered patient at a time. Vt. Stat. Ann. Tit. 18, §4472(6); 4474(1),(2)(c) (2003).

    Vermont, News - Vermont Senate votes to end marijuana prohibition; House vote fails, but legislators continue to study the issue Vermont Senate votes to end marijuana prohibition; House vote fails, but legislators continue to study the issue - Last update: September 21, 2016 | On February 25, 2016, following weeks of testimony and careful deliberation, the Vermont Senate made history when it voted 17-12 to pass S. 241 and send it to the House of Representatives. This bill would have ended Vermont’s prohibition of marijuana for adults 21 and older, creating a regulated and taxed system for marijuana production and sale. The bill encountered obstacles in the House, where key committees did not support the Senate’s approach to marijuana regulation. The bill did not pass, but House and Senate leaders ultimately came together and agreed on a plan to continue studying the issue this fall.     Regardless of what happens with the study process, the upcoming November election presents a critical opportunity to set the stage for a successful effort in 2017. In the races for governor and lieutenant governor, there is a clear contrast between candidates: Democratic nominees Sue Minter and David Zuckerman support legalization and regulation, and Republican nominees Phil Scott and Randy Brock do not.     The previous year, the Rand Corporation presented a legislatively-commissioned in-depth report on marijuana legalization and regulation options in Vermont. The 2015 report noted that about 80,000 Vermonters regularly consume marijuana, and they spend about $175 million each year buying cannabis. RAND researchers estimated Vermont could generate $20 million to $75 million annually in taxes by regulating cannabis.     Legislature passes bills to expand access for patients! | In 2016, the Vermont Legislature agreed to improve the medical marijuana law by passing S. 14, an MPP-supported bill that would enable patients with glaucoma or chronic pain to qualify for the program. (Previously, the standard was “severe pain” — a much higher standard than “chronic pain.”) The new law also reduced the required minimum provider-patient relationship period from six months to three months and included other small, yet positive, changes. Gov. Peter Shumlin signed the bill into law on June 6, and it went into effect July 1. In 2014, MPP worked with the legislature to expand Vermont’s law so more patients can benefit from safe, legal access. S. 247, sponsored by Sen. Jeanette White (D-Windham), passed the House and Senate and was signed by Gov. Shumlin May 27. This change in law eliminated the cap of 1,000 patients who were allowed to access dispensaries. It also allowed naturopaths to certify patients, allowed dispensaries to deliver marijuana to patients, and called for a study of the potential impacts of legalization and regulation.     Vermont decriminalizes marijuana possession | On June 6, 2013, Gov. Peter Shumlin signed H. 200, which eliminated the state’s criminal penalties for possessing small amounts of marijuana and replaced them with civil fines. This was a major victory for MPP and its legislative allies in Montpelier, who worked hard to build support for this sensible reform. Leading law enforcement officials, including Attorney General William Sorrell and Public Safety Commissioner Keith Flynn, supported the bill, which went into effect July 1, 2013.     As a result of this reform, Vermont police and prosecutors now waste less time and taxpayer money on enforcing laws against marijuana possession. Individuals caught possessing an ounce or less of marijuana in the Green Mountain State are now fined but do not receive a criminal conviction. Those under 21 are now generally sent to diversion.

    Vermont  - News, Vermont's first medical marijuana dispensaries open Vermont's first medical marijuana dispensaries open - WCAX - Will prices keep patients from Vt. medical marijuana dispensaries? | BURLINGTON, Vt. - After more than a year of planning, Burlington dispensary operator Shayne Lynn began selling medical marijuana to patients late last week. High expenses from state regulation will make turning a profit difficult, but he says early returns indicate the green business may be able to stay out of the red. "We're hoping by the end of the year to have 150-200 patients and that I think would help keep us viable," Lynn said. Vermont state law prevents reporters and photographers from entering the site, just one of many privacy and security provisions.

    Lynn and his small staff are growing about eight different varieties of marijuana, each directed for different medical conditions. Per ounce, his prices range from $225 to $450. "I have multiple, severe pain conditions," said a registered patient, who is a client of another dispensary. He agreed to speak with us on the condition of anonymity. He says it took more than a year to get a doctor's recommendation.

    When he finally entered a dispensary last week, his hope for pain relief dissolved. "Since I couldn't afford a daily therapeutic dose, I elected to do the hard thing and walk out with nothing," he said. He receives about $1,000 a month in disability payments and says prices ran from $330-$530 an ounce. He has prescriptions for opiates, but worries about their addictive potential. The operator of that dispensary declined our interview request.

    "Of course we'd like to be able to offer it for less. Is it possible is another question," Lynn said. Lynn says at the moment his prices don't leave much margin.     Vermont  - News, Legislation To Legalize Marijuana Introduced In Vermont Legislation To Legalize Marijuana Introduced In Vermont | Vermont Senator David Zuckerman introduced a proposal - Senate Bill 306 - to legalize recreational cannabis. Under the proposed law, the possession up to 2 ounces of cannabis, and the cultivation of up to 3 plants, would be legal for those 21 and older. State-licensed retail outlets would be authorized to distribute cannabis, which would be taxed at $50 an ounce. Just last year, Vermont lawmakers approved a measure – which was signed by the governor - to decriminalize up to an ounce of cannabis, and up to 5 grams of hashish; the proposal took effect July 1st of last year.

    In September Vermont Governor Peter Shumlin said that he believes the nation is heading towards cannabis legalization, and wants his state to be “part of the conversation”. When asked about Senate Bill 306, Shumlin’s office says that he’s likely to support it, as he would any legislation that legalizes, taxes and regulates cannabis. “Marijuana is used all over the place. People still function in society,” says Senator David Zuckerman.     Vermont  - News, Medical Marijuana on the Rise Vermont: Medical Marijuana on the Rise | High Times > Medical marijuana is more popular than ever in Vermont. According to the state Public Safety Department, more than 1,000 patients are legally using medicinal pot in Vermont – a 90 percent increase from this time a year ago. The number of caregivers – those who help patients obtain medical marijuana by growing or getting it from licensed dispensaries – is also up. There are currently 153 caregivers in Vermont – a 74 percent increase from last year.

    While many medical marijuana patients are satisfied with the current program, some growing pains have been reported. According to the owner of the state’s first medical pot dispensary, sales revenues don’t cover the cost of producing pot. The Champlain Valley Dispensary is looking for investors to expand and help offset operating costs. Additionally, some patients report difficulty obtaining certain strains that are helpful in treating their conditions. One such patient from South Burlington explains she’s spent the last three months in Colorado because the strain she prefers to treat her epilepsy is unavailable in Vermont.

    Vermont -  Two dispensaries begin serving patients in 2013! In 2011, with support from Gov. Shumlin, we had a chance to improve on Vermont’s medical marijuana law, and we took it. With the help of patients and advocates throughout Vermont, the legislature passed S. 17, a bill authorizing up to four medical marijuana dispensaries, meaning patients in Vermont will finally have a safe, legal way to obtain their medicine without having to grow their own.
