Montana, News - Voters uphold partial repeal of Montana’s medical marijuana law; new governor may support sensible reforms in 2013 Voters uphold partial repeal of Montana’s medical marijuana law; new governor may support sensible reforms in 2013 - Last Update: November 8, 2012 | Sadly, in the 2012 general election, Montana voters upheld the legislature’s decision to gut the state’s medical marijuana law by passing IR-124, a ballot referendum identical to S.B. 423, which passed and became law without Governor Brian Schweitzer’s signature in 2011. Check out this summary of S.B. 423. Some key provisions include stripping the law of its provision that recognized out-of-state cards, adding onerous restrictions for pain patients, changing possession limits to four mature plants, 12 seedlings, and one ounce of marijuana, a ban on advertising, a ban on providers receiving compensation, a ban on providers serving more than three patients, and requiring doctors who recommend to 25 or more patients to pay to be investigated. Although S.B. 423 passed in 2011, courts have so far prevented some provisions from being implemented. Unfortunately, the passage of IR-124 may result in thousands of patients losing access to medical marijuana, which would be a tragedy for patients and their families. There is, however, a glimmer of hope on the horizon. Montana’s next governor will be Democratic Attorney General Steve Bullock, an opponent of the legislature’s partial repeal. Legislators and medical marijuana advocates will have an opportunity to start fresh with the legislature in 2013 and work to pass sensible reforms that protect patients and make sure they have safe, legal access to medical marijuana.   Visit - http://www.mpp.org/states/montana.

Montana has a MEDICAL MARIJUANA (cannabis) LAW

SUMMARY:   Sixty-two percent of voters approved Initiative 148 on November 2, 2004. The law took effect that same day. It removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess written documentation from their physicians authorizing the medical use of marijuana. The law establishes a confidential state-run patient registry that issues identification cards to qualifying patients.

Approved Conditions: Cancer, glaucoma, or positive status for HIV/AIDS when the condition or disease results in symptoms that seriously and adversely affect the patient's health status; Cachexia or wasting syndrome; Severe, chronic pain that is persistent pain of severe intensity that significantly interferes with daily activities as documented by the patient's treating physician; Intractable nausea or vomiting; Epilepsy or intractable seizure disorder; Multiple sclerosis; Chron's Disease; Painful peripheral neuropathy; A central nervous system disorder resulting in chronic, painful spasticity or muscle spasms; Admittance into hospice care.

MEDICAL MARIJUANA STATUTES: Montana Medical Marijuana Act, Mont. Code Ann. §§ 50-46-1 to 50-46-2 (2007).

Possession/Cultivation: Amended to 12 seedlings (less than 12"), four mature flowering plants, and one ounce of usable marijuana. ( Originally was qualifying patient and a qualifying patient's caregiver may each possess six marijuana plants and one ounce of usable marijuana. ) "Usable marijuana" means the dried leaves and flowers of marijuana and any mixture or preparation of marijuana.

AMENDMENTS: Yes - Amended: SB 423 (100 KB) -- Passed on Apr. 28, 2011 and transmitted to the Governor on May 3, 2011, Effective: July 1, 2011. Senate Bill 423, which became law on May 14, 2011, amends the state's medical marijuana law. Among the changes mandated by this act:

  • Chronic pain patients will face more stringent requirements to qualify under the law; SB 423 changes the application process to require a Montana driver's license or state issued ID card. A second physician is required to confirm a chronic pain diagnosis.

  • Patients found guilty of marijuana DUI will have their medical marijuana privileges revoked;

  • Advising physicians will be reported to the Board of Medical Examiners if they recommend for more than 25 patients per year; Physician will be responsible for the costs of this investigation;

  • Caregivers may accept no monetary compensation for providing cannabis to qualified patients.

State FEE(s): Patient Registry Fees: Several changes appeared recentlyy at the DPHHS marijuana website. A summary:

  • Patient registration fee increase from $25 to $75, effective June 1st, 2012

  • Patient renewal fee increase from $10 to $75, effective June 1st, 2012

  • Regardless of when a registration/renewal is postmarked, if DPHHS receives it on or after June 1st, 2012, the new fee applies

  • Incorrect fees will cause the application to be denied

  • Providers application fees are $50

  • Providers must re-apply annually

  • Fees are never refunded, even if the application is incomplete or denied, or the card is later revoked

  • All applications require a photocopy of a valid (not expired) Montana driver’s license or state issued ID, to prove Montana residency. The photocopy must be legible.

  • Landlord permission forms must be notarized

There are now 11,993 registered patients in Montana, a drop of more than 2,300 in the last month. The program has shed roughly 18,000 participants in the last year.

RESOURCES: Information provided by the state on sources for medical marijuana: "The Medical Marijuana Act... allows a patient or caregiver to grow up to six plants or possess up to one ounce of usable marijuana. The department cannot give advice or referrals on how to obtain a supply of marijuana... State law is silent on where grow sites can be located." (accessed Jan. 11, 2010)

We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

Also phone call and read off and/or visit and hand deliver the info. Gather signatures for any related petitions that are happening at the time as well.

Montana, News - Voters uphold partial repeal of Montana’s medical marijuana law; new governor may support sensible reforms in 2013 Voters uphold partial repeal of Montana’s medical marijuana law; new governor may support sensible reforms in 2013 - Last Update: February 19, 2013 | Sadly, in the 2012 general election, Montana voters upheld the legislature’s decision to gut the state’s medical marijuana law by passing IR-124, a ballot referendum identical to S.B. 423, which passed and became law without Governor Brian Schweitzer’s signature in 2011. Check out this summary of S.B. 423. Some key provisions include stripping the law of its provision that recognized out-of-state cards, adding onerous restrictions for pain patients, changing possession limits to four mature plants, 12 seedlings, and one ounce of marijuana, a ban on advertising, a ban on providers receiving compensation, a ban on providers serving more than three patients, and requiring doctors who recommend to 25 or more patients to pay to be investigated.   Visit - http://www.mpp.org/states/montana.

Although S.B. 423 passed in 2011, courts have so far prevented some provisions from being implemented. Unfortunately, the passage of IR-124 may result in thousands of patients losing access to medical marijuana, which would be a tragedy for patients and their families. There is, however, a glimmer of hope on the horizon. Montana’s next governor will be Democratic Attorney General Steve Bullock, an opponent of the legislature’s partial repeal. Legislators and medical marijuana advocates will have an opportunity to start fresh with the legislature in 2013 and work to pass sensible reforms that protect patients and make sure they have safe, legal access to medical marijuana.

Feds Raid, Prosecute Montana Medical Marijuana Providers | On March 14, 2011, the same day a state Senate committee rejected a bill to repeal Montana’s medical marijuana law, federal agents made a mockery of Obama’s campaign pledge not to circumvent state medical marijuana laws by raiding more than 20 medical marijuana locations, with no warning. Since then, more than two dozen people have been indicted, some of whom have been sentenced, on related charges. One of the raided facilities was Montana Cannabis, whose former co-operator, Tom Daubert, is a political consultant who was instrumental to the success of the 2004 medical marijuana campaign. Tom invited local law enforcement and legislators in for tours, including while being filmed for the documentary film, Code of the West.

Never in any of these tours did state and local law enforcement leaders express anything but admiration and support for the ways the dispensary’s approach surpassed both the spirit and letter of the state law. But, perfect compliance with a state medical marijuana law is no defense in federal court. Tom agreed to plead guilty to federal felony charges in 2012 and was sentenced to a hefty fine and five years’ probation. Unfortunately, some of Daubert’s business partners have been convicted and are facing lengthy prison terms; one elderly caregiver, Richard Flor, died in prison while serving a five-year sentence. Montana’s marijuana laws; efforts to change them | In Montana, possession of even a single joint for non-medical purposes can land you in jail for six months, while possession of 60 grams or more (a little over two ounces) can result in a sentence of up to five years. These stiff marijuana penalties cause related negative consequences. In 2007, the Montana clearance rate for murders was only 61%, and the rape clearance rate was an embarrassing 16.9%. Meanwhile, Montana police spent their time making more than 1,300 marijuana-related arrests, more than triple the 2003 total. In 2006, Missoula County, Montana voters made marijuana possession law enforcement officers’ lowest enforcement priority. Unfortunately, last year the legislature passed a bill designed to prevent localities from passing similar initiatives. The sponsor maintained that it would nullify the Missoula County initiative, but we believe it should only apply to future initiatives. In 2009, Rep. Brady Wiseman (D-Bozeman) sponsored H.B. 541, which would have decriminalized marijuana and made possession of up to 30 grams a civil infraction, punishable only by a $50 fine. I used marajuana for years when the doctors couldn't find a drug that was legal for me to take. My body's tolorence is just to high. I shed the seizure drugs out of my system as fast as I intake them. And they cause lots of harmful damage to your internal organs, such as kidney and liver failure. When I used marajuana for three years that the doctors weren't able to help me, my seizures went down and my stomach uncers went away. I felt so much better it wasn't funny. It also helped with the massive migranes I got after having a seizure. So for me, that is more logical to use than the drugs the doctors put you on. Besides it was on this planet of ours long before we learned how to make chemical medication. Now I have a device called a VNS that controls all my seizures. Haven't had one in almost five years, and am one of the top five success stories with this device in the state of Montana. I even got my drivers liscence for the first time in my life last year. That was a major milestone for me.
